Important Notes:
These terms of service (“Terms”) govern the access and use by you, an individual, of the Hala ride-hailing services (the “Services”) made available by Hala on the Careem Platform. Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Hala.
The Services are made available on the Careem Platform and will be accessed in connection with services and content (including advertising) that Hala does not control. You acknowledge that different terms of service and privacy notices may apply to your use of the Careem Platform, and they will be shared with you from time to time through the Careem Platform. Hala does not endorse such third-party services and content and in no event shall Hala, or any of its legal representatives, administrators, successors-in-interest, permitted assigns, be responsible or liable for any such services and products.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES.

If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you regarding the access or use of the Services. Hala may immediately terminate these Terms or the Services with respect to you or generally cease offering or denying you access to the Services or any portion thereof, at any time for any reason.
Supplemental terms may apply to certain parts of the Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms will be effective upon their disclosure to you. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.
Hala may amend the Terms related to the Services from time to time. Amendments will be effective upon posting of such updated Terms at this location. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.
Our collection and use of personal information in connection with the Services is as provided in Hala’s Privacy Notice located at https://www.halaride.com/privacy-policy/.
In addition, the collection and use of personal information in connection with the Careem Platform products and services other than the Services is subject to dedicated privacy notices, a copy of which can be found at https://www.careem.com/en-AE/privacy-notice-ride/
Hala may provide the RTA, a Taxi Franchise (as defined below), a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Captain and such information or data is necessary to resolve the complaint, dispute or conflict.
The Services enable you, through the Careem Platform, to arrange and schedule transportation services with taxi drivers (“Captains”) who are employed by independent taxi franchise companies authorised by the RTA to provide such services, and under agreement with Hala (“Taxi Franchises”). Unless otherwise agreed by Hala in a separate written agreement with you, the Services are made available solely for your personal, noncommercial use. YOU ACKNOWLEDGE THAT HALA DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY INDEPENDENT TAXI FRANCHISES AND THEIR CAPTAINS WHO ARE NOT EMPLOYED BY HALA.
License.
Access and use of the Services via the Careem Platform on your personal device and to any content, information, and related materials made available via the Careem Platform is subject to your compliance with these Terms and the Careem Platform’s terms and conditions (linked above).
The license granted by the Careem Rides Group grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Services on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, noncommercial use. Any rights not expressly granted herein are reserved by Careem Rides Group and the Careem Rides Group’s licensors.
Restrictions.
With respect to your use of and access to the Services and the Careem Platform, you may not:
(i) remove any copyright, trademark or other proprietary notices from any portion of the Services.
(ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Hala or the Careem Rides Group and/or its licensors (as applicable).
(iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law.
(iv) link to, mirror or frame any portion of the Services.
(v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services.
(vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.
(vii) use the Hala Services or Careem Platform in any way that infringes any third party’s rights, including but not limited to: intellectual property rights, copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.
(viii) post, email or otherwise transmit any malicious code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or surreptitiously intercept or expropriate any system, data or personal information;
(ix) forge headers or otherwise manipulate identifiers to disguise the origin of any information transmitted through the Careem Platform;
(x) link directly or indirectly to any other websites;
(xi) transfer or sell your Account, Account’s password and/or Account’s identification to any other party; or
(xii) cause any third party to engage in the restricted activities above.
Third Party Services and Content.
The Services are made available and will be accessed in connection with third-party services and content (including advertising) that Hala does not control. You acknowledge that different terms of service and privacy notices may apply to your use of such third-party services and content. Hala does not endorse such third-party services and content and in no event shall Hala be responsible or liable for any products or services of such third-party providers.
Ownership.
The Services and all rights therein are and shall remain Hala’s property or the property of Hala’s licensors (as applicable). The Hala website and all rights herein are and shall remain Hala’s property.
Neither these Terms nor your use of the Services conveys or grants to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner Hala’s company names, logos, product and service names, trademarks or service marks or those of Hala’s licensors.
The Careem Platform and all rights in relation to the same is owned by Careem Rides or Careem Rides’ affiliates and licensors.
The Careem Platform provides a digital network that functions as a marketplace where persons (“Users”) who seek personal transportation services, such as those accessed through the Services can be matched with Captains. Also, Users can access through the Careem Platform other third-party services such as access to other transportation providers, e-payment, and delivery of goods, products, and restaurant meals. Access to such additional services will be subject to their terms and conditions as communicated to you through the Careem Platform.
User Accounts.
In order to access and use the Services, you must register for and maintain an active personal user account on the Careem Platform (“Account”). You must be at least 18 years of age. Account registration requires you to submit through the Careem Platform certain personal information, such as your name, address, mobile phone number and age. You may be required to add a valid payment method (such as a credit card or other eligible digital payment method) in order to access and use the Services. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services and may also result in Hala terminating this Agreement with you. You are responsible for all activity that occurs under your Account, even as a result of loss or theft of the device through which you access the Careem Platform. Should you suspect that any other person may be using Services through your Account, or you suspect of any other breach of security, you must notify us immediately.
User Requirements and Conduct.
The Services are not available for use by persons under the age of 18. You may not allow people under the age of 18 to receive transportation from Captains unless they are accompanied by you. You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes (e.g., no transport of unlawful or hazardous materials). In certain instances you may be asked to provide proof of identity to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.
You will not, in your use of the Services:
(i) cause nuisance, annoyance, inconvenience, or property damage, whether to Captains, the Taxi Franchises or any other party;
(ii) impersonate any person or entity;
(iii) stalk, threaten, or otherwise harass any person (including other Users making simultaneous use of the Services), or carry any weapons;
(iv) violate any law, statute, rule, permit, ordinance or regulation;
(v) post information or interact with the Careem Platform or with respect to the Services in a manner which is false, inaccurate, misleading (directly or by omission or failure to update information), defamatory, libelous, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, or illegal;
(vi) use narcotics or alcohol;
(vii) discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation; or
(viii) cause any third party to engage in the restricted activities above.
In the event that you undertake any of the above while participating in the Hala Services, a Captain shall be permitted to refuse to provide you the Hala Services or, if such Hala Services have commenced, a Captain shall be permitted to refuse to continue to provide you the Hala Services.
In addition, failure to comply with the terms of this section may result in Hala taking certain actions against you, including but not limited to: (i) immediate, temporary or permanent withdrawal of your right to use the Hala Services which may also lead to you losing access to your Account and the Careem Platform; (ii) legal action against you including proceedings for reimbursement of all costs on an (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; (iii) disclosure of such information to law enforcement authorities as Hala deems necessary; and/or (iv) immediate, temporary or permanent removal of any posting or material uploaded by you to the Hala Services and/or the Careem Platform.
Network Access and Devices.
You are responsible for obtaining the data network access necessary to use the Services. Your mobile network’s data and messaging rates and fees may apply if you access or use the Services from a wireless-enabled device, and you shall be responsible for such rates and fees. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services. Hala does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.
Communications.
By creating an Account and availing of the Services, you agree to receive communications from us, including via e-mail, text message, calls, and push notifications. You agree that texts, calls or pre-recorded messages may be generated by automatic telephone dialing systems (where allowed by and in compliance with local law). Communications from Hala may include but are not limited to: updates concerning new and existing features on Hala; communications concerning promotions run by us or our third-party partners; and news concerning Hala and industry developments. Standard text messaging charges applied by your cell phone carrier will apply to text messages we send.

Hala Promotional Codes.
Hala may, in its sole discretion, create promotional codes that may be redeemed for the Services, or other features or benefits related to the Services, subject to any additional terms that Hala establishes for the promotional code (“Promo Codes”). You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Hala; (iii) may be disabled by Hala at any time for any reason without liability to Hala; (iv) may only be used pursuant to the specific terms that Hala establishes for such Promo Code; (v) are not valid for cash; and (vi) may expire prior to your use. Hala reserves the right to withhold or deduct such promotional credits or other features or benefits obtained through the use of Promo Codes by you or any other user in the event that Hala determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or these Terms.
General Rules on Hala Competitions, Contests and Giveaways
Unless otherwise specified, Hala will conduct all competitions, contests and giveaways (each a “Competition”) as described in this section and by entering or participating in a Competition, each entrant or participant (“Entrant”) agrees to these rules, whether or not any separate additional specific terms apply to the Competition.
When entering or participating in a Competition, an Entrant may be eligible for a prize specified in the corresponding promotional material (the “Prize”). Hala may reject an entry at its own discretion, provided that such rejection will not conflict with applicable law.
The Prize is non-transferable, non-exchangeable and no cash alternative is offered. In the event of a Prize being unavailable, Hala reserves the right to offer an alternative prize of equal or greater value if circumstances beyond Hala’s control make it necessary to do so. To the extent permitted by law, the Competition Winner (defined below) will be responsible for any and all taxes incurred in relation to receipt of the Prize.
Participation in a Competition does not automatically mean that the Entrant has won the Prize. A winning entry (the “Competition Winner”) will be chosen by random draw (performed by a computer process or supervised by an independent third party) or by a panel of individuals adjudicating the entries. Reasonable efforts will be made to contact the Competition Winner but if the Competition Winner cannot be contacted or fails to reply to Hala’s communication within the communicated timeframe, Hala reserves the right to offer the prize to the next eligible Entrant. Hala will not be liable if the Prize does not reach the Competition Winner for reasons beyond Hala’s reasonable control.
Without prejudice to the “Disclaimers, Limitation of Liability & Indemnity” section, Hala will not accept responsibility or liability for any errors, omissions, interruptions, deletion, or unauthorized access to Competition entries, or entries lost or delayed, whether or not arising as a result of server functions, virus, bugs, or other causes outside Hala’s control. IN NO EVENT SHALL HALA’S TOTAL LIABILITY TO ANY ENTRANT FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION IN CONNECTION WITH ANY COMPETITION OR ANY MATERIAL PUBLISHED IN RELATION TO A COMPETITION EXCEED THE MONETARY VALUE OF THE PRIZE.
Hala reserves the right to cancel or amend the Competition and any associated terms and conditions. Any changes will be notified to the Entrants as soon as reasonably practicable. If these terms do not, or do not clearly, cater for a solution to any matter which may arise, then Hala shall have the sole discretion to decide finally on any such matter. Hala’s decisions on any aspect of the Competition are final and binding and no correspondence will be entered into about it.
Other Promotions, Bundles, Credits, Mobile Top Ups, and Referral Programs through the Careem Platform
Through your use of the Careem Platform, you may get access to promotions, bundles, credits, mobile top-ups and referral programs available to any user or potential user of the Careem Platform. These promotions, bundles, credits, mobile top-ups and referral programs have no bearing whatsoever on your Agreement or relationship with Hala and shall be subject to their respective terms and conditions.
You understand that use of the Services may result in charges to you for the services you receive from a Taxi Franchise (through their Captains) (“Charges”).
Payment via the Careem Platform
After you have received the Services from a Taxi Franchise, if you pay via a digital payment method (not cash), Hala (or if applicable, Careem Rides (or its affiliates)) through the Careem Platform will facilitate your payment of the applicable Charges on behalf of the Taxi Franchise as such Taxi Franchise’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Taxi Franchise. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Hala.
If you elect to pay via the Careem Platform, you will receive a receipt via email to the email address registered to your Account.
If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Hala via the Careem Platform may, as the Taxi Franchise’s limited payment collection agent, use a secondary payment method in your Account, if available.
Payment in Cash or Point of Sale (“POS”) Machine
After you have received the Services from a Taxi Franchise, if you pay by cash or via the POS machine provided by the Captain, the Taxi Franchise (through their Captain) collects the Charges from you directly. Charges will be inclusive of applicable taxes where required by law, including any VAT or sales tax. Charges paid by you are final and non-refundable, unless otherwise determined by Hala.
If you pay via cash or POS, you may request a receipt from the Captain.
General
All Charges are due immediately, and payment will be facilitated by Hala via the Careem Platform or the Taxi Franchise (through their Captain), depending on the preferred payment method designated in your Account.
As between you and Hala, Hala reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Services at any time in Hala’ sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. Hala will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Hala may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. You may elect to cancel your request for services or goods from a Captain at any time prior to such Captain’s arrival, in which case you may be charged a cancellation fee.
This payment structure is intended to fully compensate the Captain for the services or goods provided. Hala does not designate any portion of your payment as a tip or gratuity to the Captain. Any representation by Hala (on Hala’s website, its marketing materials or elsewhere) to the effect that tipping is “voluntary,” “not required,” and/or “included” in the payments you make for services provided is not intended to suggest that Hala provides any additional amounts, beyond those described above, to Captains. You understand and agree that, while you are free to provide additional payment as a gratuity to any Captain who provides you with services or goods obtained through the Service, you are under no obligation to do so. Gratuities are voluntary. After you have received services or goods obtained through the Service, you will have the opportunity to rate your experience and leave additional feedback about your Captain.
Repair or Cleaning Fees.
You shall be responsible for the cost of repair for damage to, or necessary cleaning of, Taxi Franchise vehicles and property resulting from use of the Services under your Account in excess of normal “wear and tear” damages and necessary cleaning (“Repair or Cleaning”). In the event that a Captain or Taxi Franchise reports the need for Repair or Cleaning, and such Repair or Cleaning request is verified by Hala in Hala’s reasonable discretion, Hala reserves the right to facilitate payment (including via the Careem Platform) by you to the Taxi Franchise for the reasonable cost of such Repair or Cleaning using your payment method designated in your Account. Such amounts will be transferred to the applicable Taxi Franchise and are non-refundable.
DISCLAIMER.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HALA DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, HALA MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. HALA DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF CAPTAINS AND/OR TAXI FRANCHISES. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND ANY SERVICE OR GOOD REQUESTED IN CONNECTION THEREWITH, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
Hala is not responsible for the conduct, whether online or offline, of any User or Captain. You are encouraged to use a reasonable degree of sensibility and caution when interacting with other Users, Captains, or Taxi Franchises.
Hala is not required to procure insurance for, nor is Hala responsible for private belongings, including the loss of private belongings as a result of theft or snatching or because the belongings are left in a vehicle.
By using the Services, you agree to accept such risks and agree that Hala is not responsible for the acts or omissions of Users, Captains, or Taxi Franchises.
Location data provided in relation to the provision of the Hala Services via the Careem Platform is for basic location purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Hala does not guarantee the availability, accuracy, completeness, reliability, or timeliness of location data tracked or displayed in relation to the provision of the Hala Services. Certain information, including geolocational data, you upload, provide, or post on the Careem Platform may be accessible to Hala, selected partners and relevant Captains.
LIMITATION OF LIABILITY.
HALA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF HALA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HALA SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY CAPTAIN AND/OR TAXI FRANCHISE, EVEN IF HALA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HALA SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND HALA’S REASONABLE CONTROL. IN NO EVENT SHALL HALA’S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED TWO THOUSAND UNITED STATES DOLLARS OR ITS EQUIVALENT IN YOUR ACCOUNT CURRENCY.
HALA’S SERVICES MAY BE USED BY YOU TO REQUEST AND SCHEDULE TRANSPORTATION SERVICES WITH CAPTAINS, BUT YOU AGREE THAT HALA HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY TRANSPORTATION SERVICES PROVIDED TO YOU BY TAXI FRANCHISES AND CAPTAINS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS.
THE LIMITATIONS AND DISCLAIMER IN THIS SECTION 5 DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
Indemnity.
You agree to indemnify and hold Hala and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of the Services or services obtained through your use of the Services; (ii) your breach or violation of any of these Terms; or (iii) your violation of the rights of any third party, including Taxi Franchises and Captains.
This Agreement is governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates.
Any dispute, conflict, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof or the use of the Hala Services (collectively, “Disputes“) will be first mandatorily submitted to mediation proceedings under the International Chamber of Commerce Mediation Rules (“ICC Mediation Rules”). If such a Dispute has not been settled within sixty (60) days after a request for mediation has been submitted under such ICC Mediation Rules, such a Dispute can be referred to and will be exclusively and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (“ICC Arbitration Rules”). The ICC Rules’ Emergency Arbitrator provisions are excluded. The Dispute will be resolved by one (1) arbitrator to be appointed in accordance with the ICC Rules. The place of both mediation and arbitration will be the Emirate of Dubai, United Arab Emirates. The language of the mediation and/or arbitration will be English, unless you do not speak English, in which case the mediation and/or arbitration will be conducted in both English and your native language. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, correspondence from and to the International Chamber of Commerce, correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, will remain strictly confidential and will not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.
Claims of Copyright Infringement.
Claims of copyright or trademark infringement must be sent to legal@halaride.com. Claims sent to any other contact will neither be received nor acknowledged.
Notice.
Hala may give notice by means of a general notice on the Services, electronic mail to your email address in your Account, or by written communication sent to your address as outlined in your Account.
You may give notice to Hala by written communication by sending an email to legal@halaride.com.
General.
You may not assign or transfer these Terms in whole or in part without Hala’s prior written approval. You give your approval to Hala for it to assign or transfer these Terms in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of Hala’s equity, business or assets; or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, Hala or any Taxi Franchise or Captain as a result of the contract between you and Hala or use of the Services.
Hala may subcontract or otherwise engage Careem Rides, directly or through its affiliates and subcontractors for the provision of its obligations under this Agreement. Such engagement shall always be in line with Hala’s privacy notice (linked above).
If any provision of these Terms is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms but the legality, validity and enforceability of the other provisions in these Terms shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms. These Terms constitute the entire agreement and understanding of the parties with respect to its subject matter and replace and supersede all prior or contemporaneous agreements or undertakings regarding such subject matter. In these Terms, the words “including” and “include” mean “including, but not limited to”.
